What Is A Collaborative Divorce?

Sometimes, a couple may wish to end their marriage without the stress or hostility usually associated with a typical litigated divorce. Collaborative divorce is a method for ending the marriage through cooperation and negotiation.

This article lays out the advantages of a collaborative divorce, things people misunderstand about them and circumstances where one may not want to pursue one.

Collaborative Divorce: Meaning

A collaborative divorce is a legal process that encourages both parties to work together as an alternative to expensive litigation. It applies only to uncontested divorce where both spouses get along well enough and agree to settle disputes out of court through negotiation.

Each spouse is entitled to an attorney to lead the proceedings. Couples can also invite financial planners and counselors to advise them on property division, custody and spousal support.

Collaborative law is relatively new in most states. For example, the Uniform Collaborative Law Act (UCLA) was passed in Colorado in 2021. It specifies the requirements for collaborative divorce in the state, including hiring an attorney. It also deems communications made during collaboration inadmissible in later court proceedings. Most states have similar requirements, but working with a local divorce attorney will ensure your dissolution follows the parameters of the collaborative divorce definition in your state.
